These Terms and Conditions ("Terms") govern your use of dumpsterflash.com (the "Platform") and every dumpster rental booked through it. The Platform is operated by Dumpster Flash LLC, a Florida limited liability company with its mailing address at 7901 4th St N #36329, St. Petersburg, FL 33702 ("Dumpster Flash," "we," "us" or "our").
By using the Platform, booking a rental or applying to become a partner, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.
1. Who we are and how the Platform works
Dumpster Flash is a dumpster rental company and a rental marketplace:
- Our own dumpsters. Dumpster Flash LLC owns and operates its own roll-off dumpsters and delivers them in the areas we serve directly.
- Our partner network. To serve as many regions as possible, we also work with a network of independent, locally owned dumpster rental companies ("Partners"). Through the Platform we act as an intermediary: we connect you with a Partner, take the booking and collect the payment, and the Partner delivers and picks up the dumpster.
In these Terms, the company that delivers your dumpster, whether Dumpster Flash itself or a Partner, is called the "Provider."
How a booking works
- Search. You enter the ZIP Code of your project. We show the Providers that serve that location, based on each Provider's service area and the driving distance from its yard.
- Choose. You freely choose the Provider, the dumpster size and the rental period. We never assign a Provider for you.
- Details. You enter your contact information, the delivery address and the delivery date. We verify the address and confirm that the Provider can reach it before you continue.
- Review and pay. You review the price, taxes and total, then pay Dumpster Flash LLC by card or by Zelle.
- Delivery and pickup. After your payment is confirmed, the Provider is notified, delivers the dumpster on the scheduled date and picks it up at the end of the rental period.
2. Eligibility and accounts
You must be at least 18 years old and able to enter into a binding contract to use the Platform. You agree to give accurate, current and complete information, and to keep any login credentials confidential. You are responsible for activity under your account.
3. Prices, taxes and payment
- Price. The rental price shown for each dumpster is set by the Provider and includes delivery, pickup, the stated rental period and the stated included weight (tons). All prices are in U.S. dollars.
- Additional fees. If a Provider charges additional fees, they are shown as separate lines before you pay.
- Sales tax. Sales tax is calculated for the state of the delivery address at the rate in effect when you place the order, and is shown before you pay.
- Prices are confirmed by our system. Prices, distances and availability are always calculated on our servers. If a price or availability changes before you place the order, we will ask you to review the new terms.
- Who you pay. You pay Dumpster Flash LLC, which collects the payment on behalf of itself or the Partner. Card payments are processed securely by Stripe; we never see or store your full card number. Zelle payments are confirmed manually by our team.
- Payment window. An order that has not been paid holds the dumpster for up to 48 hours. If payment is not completed within that time, the order may be released.
- Extra charges after delivery. Charges such as weight above the included tons, prohibited items, extra rental days, or a trip fee when the dumpster cannot be delivered or picked up because of the site conditions may apply. Any such charge will be explained to you and will not be charged without notice.
4. Cancellations and refunds
- You may cancel an order at no cost before it is paid.
- If you cancel a paid order at least 24 hours before the scheduled delivery date, we will refund the amount you paid to the original payment method.
- Cancellations requested less than 24 hours before delivery, or after the Provider has been dispatched, are reviewed case by case and may be refunded minus costs already incurred by the Provider. We will tell you the amount before processing it.
- To cancel or request a refund, use our contact form and include your order number.
- If a Provider cannot fulfill a paid order, we will try to offer another Provider; if none is available, we will refund you in full.
5. Your responsibilities as a customer
- Placement and access. Provide a safe, legal and accessible location for the dumpster, with enough clearance for a roll-off truck. Remove vehicles and obstacles before delivery and pickup.
- Permits. A permit is usually not required when the dumpster sits on private property. Placing a dumpster on a public street or sidewalk may require a permit from your city or county, and obtaining it is your responsibility.
- Surfaces. Dumpsters and trucks are heavy. Neither Dumpster Flash nor the Provider is responsible for normal wear or damage to driveways, lawns, curbs or other surfaces at the location you choose, unless caused by negligence.
- Prohibited items. Do not place hazardous materials in the dumpster, including paint, chemicals, solvents, oils, fuels, batteries, tires, asbestos, medical waste, or anything prohibited by law. Local rules vary; the Provider may confirm restrictions for your area. You may be charged the costs of removing or disposing of prohibited items.
- Loading. Do not overfill the dumpster above its walls or exceed its weight limit.
- Use. Use the dumpster only for lawful purposes and only at the delivery address.
6. Delivery, pickup and proof of delivery
Delivery and pickup dates are scheduled when you book. Delivery windows may be affected by weather, traffic, road conditions or safety issues; the Provider will make reasonable efforts to keep the schedule. When the dumpster is delivered, the Provider takes photos of it at the location. These photos are attached to your order as proof of delivery and are available to you through your order link.
7. Communications by email and text message (SMS)
Customers
- Email. By placing an order, you agree to receive transactional emails about your rental and payment, including order confirmation, payment instructions and confirmation, delivery and pickup updates. These emails are part of the service.
- Text messages. If you check "Text me order updates" when booking, you agree to receive automated transactional text messages from Dumpster Flash at the mobile number you provided, such as: order received with a secure payment link, payment confirmation, delivery and pickup notices. Consent to receive text messages is not a condition of purchase; you can uncheck the box and still book.
Partners
- By applying to become a Partner or activating a Partner account, you agree to receive emails about your application, account, new paid orders, changes that require approval and payouts.
- If you opt in, you also agree to receive automated text messages at your business phone number about new paid orders (so you can prepare the delivery) and payouts. You can turn text alerts on or off at any time in your Partner Dashboard.

- Cost: message and data rates may apply.
- Opt out: reply STOP to any message to stop receiving texts. Reply HELP for help, or contact us through our contact form.

- We do not sell your mobile number or share it with third parties for their marketing. See our Privacy Policy.
8. Terms for Partners
These additional terms apply to companies that join the Dumpster Flash partner network.
- Application and approval. Partners apply through the Platform. Dumpster Flash reviews every application and may approve or decline it at its discretion. Approved Partners receive access to the Partner Dashboard.
- Independent businesses. Partners are independent businesses, not employees or agents of Dumpster Flash. Each Partner is responsible for its own equipment, drivers, vehicles, licenses, permits, insurance and compliance with all applicable laws.
- Prices and commission. Partners set the base price of each dumpster and rental period. Customers pay exactly that price, plus any additional fees and sales tax. Dumpster Flash charges a commission (a percentage or a fixed amount, set per Partner and shown in the Partner Dashboard), calculated only on the rental price, never on fees or taxes. The Partner receives the rental price minus the commission, plus any additional fees.
- Payouts. Dumpster Flash collects customer payments and pays Partners either by Stripe Connect after the dumpster is picked up, or by Zelle after the customer's payment is confirmed, once the Partner's payout details have been verified by Dumpster Flash. One payout is made per order.
- Orders. Partners are notified only after a customer's payment is confirmed. Partners must deliver and pick up on the scheduled dates, take the three required delivery photos, and update the order status in the Partner Dashboard.
- Changes that need approval. Changes to prices, fees, service radius, location, new dumpster offers and company details are reviewed by Dumpster Flash before they take effect.
- Customer data. Partners may use customer information received through the Platform only to fulfill the related order, must keep it confidential and secure, and may not use it for marketing.
- Bookings stay on the Platform. Partners agree not to ask customers met through the Platform to pay outside of it for the same rental.
- Suspension. Dumpster Flash may suspend or remove a Partner that does not meet these Terms, service standards or the law.
9. Our role and limitation of liability
When the Provider is a Partner, the Partner is solely responsible for performing the delivery, rental and pickup services and for its equipment and personnel. Dumpster Flash is responsible for operating the Platform, processing payments and handling customer support.
To the maximum extent permitted by law, the Platform is provided "as is" and "as available," and Dumpster Flash will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, arising from the use of the Platform or the services. Our total liability for any claim related to an order is limited to the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Indemnification
You agree to indemnify and hold harmless Dumpster Flash and its members, managers and employees from claims, damages and expenses (including reasonable attorneys' fees) arising from your misuse of the Platform or a dumpster, your violation of these Terms or the law, or, for Partners, the services you perform.
11. Changes to these Terms
We may update these Terms from time to time. The version and effective date are shown at the top of this page. Changes apply to bookings and applications made after the new effective date; the version you accepted remains on record with your order or application.
12. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any dispute will be resolved in the state or federal courts located in Pinellas County, Florida, unless applicable law requires otherwise.
